This includes, but is not limited to, any loss of data, damage to your hardware or software, or any interruption of service.
We make every effort to ensure that the Platform is secure and free from defects; however, we do not guarantee uninterrupted access or error-free functionality. You agree to use the Platform at your own risk and acknowledge that certain circumstances may arise which are beyond our control.
You agree to indemnify, defend, and hold harmless Nostifo, its employees, officers, and affiliates from any claims, demands, or damages, including legal fees, arising out of or in connection with your use of the Platform, your violation of this Agreement, your infringement on any rights of another party, or your engagement in any activity that could harm the reputation, integrity, or operation of the Platform.
This indemnification clause will survive the termination of your access and use of the Platform.
Nostifo reserves the right to terminate your access or use of the Platform at any time, without notice, if you breach any provision of this Agreement or if your conduct is deemed harmful to the Platform or other users. Upon termination, you must immediately cease using the Platform and all associated content.
The termination of your access does not relieve you of any obligations to indemnify Nostifo or any liability for any actions taken prior to termination.
Any disputes arising from or related to your use of the Platform or this Agreement shall first be subject to informal negotiations. If the dispute cannot be resolved through such means, you agree to submit the matter to binding arbitration in accordance with the rules and procedures applicable to such arbitration. The arbitration shall take place in a mutually agreed-upon venue within the jurisdiction where Nostifo is established, unless prohibited by law.
This Agreement and any related disputes shall be governed by and construed in accordance with the laws of the United States. Notwithstanding the above, you may pursue any remedies available to you under applicable state or federal law.

This Agreement constitutes the entire understanding between you and Nostifo with respect to your use of the Platform and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Nostifo.
If for any reason any provision of this Agreement is held to be invalid or unenforceable, that provision will be interpreted in a manner consistent with applicable law that most closely reflects the original intent, and the remaining provisions of the Agreement will remain in full force and effect. No waiver of any breach or default of any provision of this Agreement shall be construed as a waiver of any subsequent breach or default.
Any failure by Nostifo to enforce any right or provision of this Agreement will not constitute a waiver of such right or provision unless acknowledged and agreed to by Nostifo in writing.
In compliance with current advertising recommendations, including those set forth by Microsoft Advertising, any advertisements, promotions, or third-party sponsored content displayed on or through the Platform will adhere to applicable advertising standards and regulations. We strive to ensure that all advertising content is clearly identifiable, does not contain misleading or false claims, and respects your privacy and rights.
Our policies for handling advertising content are subject to change, and you will be notified through appropriate channels should any major alterations occur.
By using the Platform, you acknowledge that you have read, understood, and agreed to all of the terms and conditions outlined in this Agreement. You further agree to abide by all policies and procedures implemented by Nostifo as well as by any future updates to these policies.
If you do not agree to these terms, your sole recourse is to cease using the Platform. Continued access or use of the Platform constitutes your ongoing acceptance of this Agreement and any modifications that may be made from time to time.
